Use of the Site
i. Transaction Eligibility
The Site precludes the following persons from transacting herein:
a. Persons who do not have the capacity to enter into contracts as provided by the law viz: infants/minors, persons of unsound mind etc.
b. Persons acting for 3rd parties without documentary evidence from the said 3rd party.
Hence, we grant you a non-transferable and revocable license to use the Site, under the terms described, for the purpose of shopping for personal items sold on the Site. Commercial use or use on behalf of any third party is prohibited, except as explicitly permitted by us in advance. Applicable Law and Jurisdiction
These Terms and Conditions shall be interpreted and governed by the laws in force in the Federal Republic of Nigeria. Subject to the Dispute Resolution section below, each party hereby agrees to submit to the jurisdiction of the courts of Nigeria and to waive any objections based upon venue.
Dispute Resolution
Any controversy, claim or dispute arising out of or relating to these Terms and Conditions will be referred first to Mediation a private and confidential dispute resolution mechanism and where mediation fails Arbitration is the next option before pursuing any matter via litigation. The Mediation and/or Arbitration proceedings would be before a single mediator/arbitrator (as the case may be), legally trained and vast in the area of commerce and commercial transactions in Nigeria and is independent of either party. Any resulting agreement/ award from the mediation/ arbitration (as the case may be) would become binding and conclusive between the parties. All proceedings shall be in accordance with the Laws of Nigeria.
Termination
In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the or revoke any or all of your rights granted under the terms.
Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and we shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part.
Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You furthermore agree that the Site shall not be liable to you or to any other person as a result of any such suspension or termination except regarding valid deliveries ordered before such termination.
If you are dissatisfied with the Site or with any terms, conditions, rules, policies, guidelines, or practices of E-Cart Internet Services in operating the Site, your sole and exclusive remedy is to discontinue using the Site.
Taxes
As a VAT registered entity, The 1K Shop, through My Delight Enterprise, is required to charge and remit to the federal authorities 7.5% VAT on all eligible items sold by the store.
Part Payments
With a view to serving our customers better, we launched part payments in March 2022. Using either or both of the two available payment methods, you can now split payment for any or all products in your order in two installments of 60%, 40%. First installment is to be paid upon checkout, while the second installment is to be made before products are shipped. Note that the complete VAT is charged upon payment of the first installment.
In cases where split payment is applied to only some products, and the customers wants the immediate delivery of the fully paid for products, the customer should please such request in the checkout note. In such cases, the customer will be required to pay a second delivery fee upon complete payment for the other products. Kindly contact the sales team, if you require any further assistance.
